Section 149 certificate name change, but still the same

The Environmental Planning and Assessment Act 1979 (NSW) (EPA Act) has been updated and section 149 certificates are now called section 10.7 certificates.

The Conveyancing (Sale of Land) Regulation 2017 (NSW) (CSLR) still refers to a section 149 certificate, with a certificate issued under section 149(2) of the EPA Act being a prescribed document to the contract for sale. 

Despite the change in section and name of the planning certificate in the EPA Act, the CSLR still refers to the former section and name.
“When ordering a planning certificate, it is still the same thing,” says Sarah Bester, general manager of Ray White Double Bay and REINSW Residential Sales Chapter Committee member. “It still has the same time limits on validity and remains an essential document in the contract.”
