You may have seen the NSW Fair Trading media release issued on Sunday announcing the launch of its Name and Shame Register, which includes real estate agents and agencies.
We want to provide clarity on what this means for you while outlining the steps available.
What NSW Fair Trading has announced
Government has confirmed that agents or agencies who receive a penalty notice may be published on the Name and Shame Register for a period of not less than 12 months. Depending on the nature and severity of the matter, listings may extend to five years, ten years, or in some cases be permanent.
The register is publicly accessible, has been promoted via social media, and includes public warnings as well
REINSW’s position
REINSW was involved in a targeted confidential consultation with Government and, while we support measures that improve professional standards and consumer confidence, we did not support the register as presented to us, flagging our concerns about its potential impact on agents and agencies.
Why this matters
We recognise that the vast majority of agents are trying to do the right thing and operate ethically in a complex regulatory environment. We continue to strongly recommend that Government work closely with agents and industry bodies before listing individuals or businesses on the register.
This is not limited to real estate
While real estate agents are the first group impacted, NSW Fair Trading has publicly communicated that the register will roll out across a range of regulated industries, including towing operators, tattooists and police-related services.
What you should do now
- Check if you or your business is listed on the register
- Understand the dispute and suppression process: If you believe you have been incorrectly listed or wish to dispute the information published, there is a dispute process which you can review here.
- Be aware of publication timing: The NSW Fair Trading website explains when listings are published and how long they remain visible online.
