Under the Residential Tenancies Act 2010, a landlord may apply to the Tribunal for a termination order before the termination date specified in a non-payment termination notice. The Tribunal must not, however, consider any such application until after the termination date.
Where a termination notice for non-payment of rent is served by post, we strongly advise that an application to the Tribunal not be made until after the fourth business day, being when the termination notice is deemed served.
For termination notices served by a landlord on other grounds, an application to the Tribunal can only be made after the termination date specified in the relevant termination notice.
