Revision of NCAT expert evidence document

The NSW Civil and Administrative Tribunal (NCAT) President has revised the ‘Procedural Direction 3 - Expert Evidence’ document which sets out how witnesses provide evidence.

Expert witnesses are sometimes called upon to provide NCAT with evidence about technical matters or areas of specialised knowledge relevant to an issue to be determined in proceedings.

However in order to help differentiate between proceedings with different approaches, NCAT has revised its Expert Evidence Procedural Direction document. Read it in full here.

This has been done to help parties better understand where it is appropriate to take a stricter approach to expert evidence (e.g. when the Tribunal is bound by the rules of evidence) and those where consideration of proportionality and fairness require a less strict.
