REINSW provides recommendations on how best to prepare for NCAT hearings based on situations which could potentially appear before a Tribunal.
Question
When a pest infestation occurs at a property, if by chance it moves into a Tribunal hearing due to complications, does NCAT prefer or require to have a written report from the exterminator (pest company) that confirms the infestation has been eradicated?
Answer
Having considered NCAT practice and procedure, REINSW is of the opinion that providing a pest report which clearly states that a pest infestation has been eradicated is substantial proof that the infestation has been dealt with effectively.
Photos can be considered at a hearing however a report from the pest company carries more weight as evidence of the removal of the pest problem.
