The CTTT and the Residential Tenancies Act 2010

Transitional arrangements  

The transitional provisions in the New Act provide that:
  • the Residential Tenancies Act 1987 (the old Act) continues to apply in relation to any termination notice given before 31 January 2011 or CTTT proceedings commenced before 31 January 2011, relating to the termination of an existing residential tenancy agreement or abandoned goods;
  • the old Act continues to apply in relation to the enforcement of a termination of a residential tenancy agreement that occurred before 31 January 2011 and in relation to the recovery of possession of residential premises consequential on any such termination.
  • otherwise, most applications to the CTTT made after 31 January 2011, will be determined under the new Residential Tenancies Act 2010.

New CTTT forms

With the commencement of the new Residential Tenancies Act, the CTTT has advised REINSW that it has updated a number of its application forms in its Tenancy and Social Housing Division.
