New prescribed document for annexure to Contract for Sale of Land

The Conveyancing (Sale of Land) Regulation 2005 will be automatically repealed on 1 September 2010 and replaced with the Conveyancing (Sale of Land) Regulation 2010.

The new Regulation introduces a notice with the heading “Warning – Swimming Pools” as a new prescribed document, which is required for all contracts whether or not there is a swimming pool located on the property.

The new Regulation also provides that the swimming pool notice and the other prescribed notices currently included in the Contract for Sale of Land 2005 edition should be printed in a designated font size.

Agents are advised to contact their solicitor/conveyancer to ensure that all contracts to be exchanged after 31 August 2010 comply with the new Regulation. If a contract does not comply, then there is a right of rescission.
