Landowners' right to protect property

The NSW Government has released draft legislation that gives beachfront landlowners the right to shield their property against coastal erosion.

The Coastal Protection and Other Legislation Amendment Bill 2010 will permit landowners to place sand, sandbags or other emergency barriers (excluding rocks, concrete, construction waste or debris) on beaches.

The Bill follows the recent Land and Environment Court decision in Vaughan v Byron Shire Council which held that Byron Shire Council must maintain, monitor and repair beach stabilisation works designed to offset the effects of erosion caused by severe storms.
